KindClear referral terms — pre-launch draft

These draft terms make the proposed relationship clear: KindClear introduces enquiries, while the independent provider assesses, contracts for and performs the clearance work.

KindClear's role

KindClear provides information and may forward a suitable enquiry to an independent provider. It does not currently offer or perform property-clearance work and does not provide waste transport, valuation, legal or probate services.

The exact referral activity will not begin until the Environment Agency has been asked whether the model requires waste-broker registration.

The provider's role

The provider decides whether to accept an enquiry, communicates directly with the customer, inspects the property where necessary, issues the quotation and agrees its own contract. The provider is responsible for staff, vehicles, insurance, waste registration, work quality, invoicing and legal compliance.

A provider appearing on the website does not become an employee, agent or branch of KindClear.

The customer's responsibilities

KindClear cannot resolve ownership disputes, probate authority or landlord-and-tenant questions.

  • Provide accurate information about the property, access and contents
  • Have authority to instruct removal of the items concerned
  • Identify possessions that must remain or need assessment
  • Tell the provider about hazardous or unusual items
  • Read and accept the provider's quotation and terms directly
  • Check the provider's registration details before work starts

Payment and referral fees

The customer pays the provider directly for any clearance work unless a different arrangement is clearly documented in the future. KindClear may charge the provider an advertising or qualified-enquiry fee.

The definition of a qualified enquiry, duplicate rules, invalid-lead process and provider payment terms belong in a separate provider agreement.

Complaints and limitations

Complaints about the quotation, work, damage or payment should first be raised with the contracting provider. KindClear should provide a route for reporting concerns that may affect whether the provider continues receiving enquiries.

Any clauses limiting liability, choosing governing law or setting formal complaint deadlines require professional legal review and are intentionally not invented in this draft.
